It could be said that it is Phil Cannella’s mission in life to help people in and approaching retirement to live out the last years of their lives protected from the most common problems they face: 1) Running out of money and 2) Needing some form of long term care but not having the financial wherewithal.
Phil Cannella Lawsuit: It came as a surprise then that a former employee who was a little more advanced in life in terms of age would file a claim for discrimination against Phil Cannella based on his age and disability, being in a protected class per the ADA (American Disability Act). It was a baffling claim considering everything Phil stands for.
Phil Cannella Lawsuit: To explain a little as to what disability discrimination is, this text was gotten from the EEOC:
“Disability discrimination occurs when an employer or other entity covered by the Americans with Disabilities Act, as amended, or the Rehabilitation Act, as amended, treats a qualified individual with a disability who is an employee or applicant unfavorably because she has a disability.”
“Disability discrimination also occurs when a covered employer or other entity treats an applicant or employee less favorably because she has a history of a disability (such as cancer that is controlled or in remission) or because she is believed to have a physical or mental impairment that is not transitory (lasting or expected to last six months or less) and minor (even if she does not have such an impairment).”
“The law requires an employer to provide reasonable accommodation to an employee or job applicant with a disability, unless doing so would cause significant difficulty or expense for the employer (‘undue hardship’).”
“The law also protects people from discrimination based on their relationship with a person with a disability (even if they do not themselves have a disability). It came as a shock to Phil that someone he had helped so often and so long would come back and bite and worse, file a frivolous claim that had no basis in fact.
Phil Cannella, being the compassionate man that he is, did not strike back, he did not seek revenge, he did not seek a way to get even. In a cool and collected fashion he documented the truth. Much like his media company whose motto is “bringing truth to the America retiree” Phil sought to put truth on the line and present it to the government agencies investigating the harassment claim.
While lies can be very entertaining, and certainly gripping and definitely the fodder of rumormongers, the truth is powerful enough to cut through the lies. Truth is hard to challenge for truth is based on logic while lies are based on illogic.
After Phil Cannella documented all he had done for this employee, all the adjustments he made to accommodate this employee due to his disability, the EEOC (Equal Employment Opportunity Commission) and the PHRC (Pennsylvania Human Relations Commission) saw through the façade and dismissed the case against Phil completely stating that the allegations lacked substance.
This was a real testimony to the power of the truth against the backdrop of lies. Once again Phil Cannella was vindicated and continues his mission.
